Terms of Use & Privacy Policy
Last updated: January 15, 2025
This single document combines our website Terms of Use and our Privacy Policy for horizon-track.com (the "Site"). It governs how you may use the Site and explains how we handle personal data.
TERMS OF USE
1. The Service
The Site provides a public tracking lookup. Visitors may enter a unique tracking number (a "Tracking Number") to view related status updates, timestamps, locations, and other events (collectively, "Tracking Information"). We may update or refine features from time to time.
No registration is required to use the lookup. If optional features are introduced later that require an account, additional terms may apply.
2. Access & Acceptable Use
You may use the Site only for lawful purposes and in accordance with this document. You agree not to:
- Interfere with or disrupt the Site or attempt to bypass rate limits, security, or technical protections
- Access, search, or collect information from the Site by automated means (scraping, bots) unless expressly permitted by us in writing
- Upload, publish, or transmit content that is unlawful, harmful, deceptive, or infringes the rights of others
We monitor usage for security, reliability, and to prevent abuse.
3. Information Displayed on the Site
Tracking Information and other content presented on the Site are provided for information only. While we aim for clarity and availability, we do not guarantee that content will be error-free, complete, or current at all times. Time values may be normalized to a labelled time zone. We may revise, reformat, or remove content to improve clarity, safety, or compliance.
4. Third-party Services & Links
The Site may link to or interoperate with third-party websites or services ("Third-Party Services"). We are not responsible for Third-Party Services, their content, or their policies. Your use of Third-Party Services is governed by their terms.
5. Intellectual Property
The Site, its interfaces, designs, software, and content are protected by intellectual property laws and are owned by us or our licensors. Subject to your compliance with this document, we grant you a limited, non-exclusive, revocable, non-transferable right to access and use the Site for its intended purpose. Except as allowed by law, you may not copy, modify, reverse-engineer, or create derivative works of the Site.
Third-party names, logos, and marks are the property of their respective owners and are used for identification only.
6. Availability, Support & Changes
We aim to keep the Site available, but uninterrupted or error-free operation is not guaranteed. The Site may be temporarily unavailable due to maintenance, updates, or events beyond our reasonable control. We may modify or discontinue features; where practicable, we will provide reasonable notice of material changes.
Support is available via info@horizon-track.com or other channels listed on the Site.
7. Disclaimers
To the maximum extent permitted by law, the Site and all content are provided "as is" and "as available." We disclaim all warranties, whether express, implied, or statutory, including any implied warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising out of or related to your use of the Site. Our total aggregate liability for all claims relating to the Site will not exceed €100 (one hundred euros).
Nothing in this section limits liability where it cannot be limited under applicable law.
9. Suspension & Termination
We may suspend or restrict access to the Site immediately if we reasonably believe you have breached this document, engaged in unlawful conduct, or compromised the Site's security or integrity. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, liability limits, governing law) will continue to apply.
PRIVACY POLICY
This section explains how we handle personal data on horizon-track.com in accordance with applicable data-protection laws (e.g., GDPR in the EEA/UK). For any questions, contact info@horizon-track.com.
10. Roles
- For Site telemetry and communications, we act as data controller.
- For public tracking pages that display Tracking Information provided by a business customer, we generally act on that customer's documented instructions. In that context, the customer is the controller for the tracking page content and we are their processor. We remain controller for Site logs/security.
11. What We Collect
Because the Site is a public lookup without registration, we collect only what is necessary to operate the Site and display Tracking Information.
A) Lookup & Security Telemetry (Controller)
- Data: IP address, date/time of request, request paths (including any tracking number you enter), browser/device information, referrer, error details; limited security/abuse logs.
- Why: Deliver requested pages; ensure security and reliability; prevent abuse and troubleshoot.
- Legal basis (EEA/UK): Legitimate interests in operating a secure, reliable service (Art. 6(1)(f)).
B) Tracking Page Content (Typically Processor)
- Data: Status updates, timestamps, locations, and related shipment information associated with a tracking number (Tracking Information). Public tracking pages are intended for recipients of the tracking number and parties they share it with.
- Why: Make the tracking timeline viewable.
- Legal basis: Determined by the business customer acting as controller (commonly, performance of a contract and/or legitimate interests).
- Display defaults: To protect privacy, public pages should avoid showing full recipient addresses or phone numbers. Where enabled by the customer, we display city/postal code and/or recipient initials by default.
C) Contact & Support (Controller)
- Data: Name, email, and message content when you contact us.
- Why: Respond to your request and provide support.
- Legal basis: Performance of a contract or legitimate interests in answering your request.
D) Cookies
- We use strictly necessary and essential cookies to operate the Site (e.g., session/load-balancing/security).
- If we enable non-essential cookies (e.g., analytics), we will request consent where required by law and provide details on the Site.
12. Sources
- Directly from you (tracking number entered; messages sent to us)
- From our business customers who provide Tracking Information for display
- Automatically from your browser/device when you access the Site
13. Purposes of Processing
- Deliver and operate the public tracking lookup
- Display Tracking Information associated with a tracking number
- Maintain security, prevent abuse, detect fraud, and troubleshoot
- Measure uptime/performance and improve the Site
- Comply with legal obligations and respond to lawful requests
- Respond to your communications and support requests
We do not use Site telemetry to create marketing profiles.
14. Sharing & Sub-processors
We use service providers acting as processors to help us operate the Site (e.g., cloud hosting, content delivery network, email delivery, error monitoring, DDoS protection). We may also share data where required by law, to protect rights and users, to investigate abuse/security incidents, or in connection with a reorganization, merger, or sale of assets (where permitted by law).
15. International Transfers
Where personal data is transferred outside your country (e.g., from the EEA/UK to a country without an adequacy decision), we implement appropriate safeguards, such as the EU Standard Contractual Clauses (and the UK IDTA/UK Addendum as applicable), plus technical and organizational measures.
16. Retention
- Server logs & security telemetry: Typically 30–90 days, unless needed longer to investigate an incident.
- Public tracking pages: Available for a limited period after the final event, then archived or deleted.
- Contact/support messages: Typically up to 24 months. We may keep minimal records necessary to comply with legal obligations and to prevent abuse.
17. Your Rights
Depending on your location, you may have rights to access, rectify, erase, restrict, object, and data portability.
- For tracking page content supplied by a business customer, please contact that customer (the controller). We will assist them as their processor.
- For Site telemetry or communications you sent us directly, contact info@horizon-track.com. You can also lodge a complaint with your local data-protection authority.
18. Security
We apply technical and organizational measures designed to protect personal data, including encryption in transit, access controls, least-privilege, and audit logging. No Internet service is 100% secure; we continuously improve our safeguards.
19. Changes to this Document
We may update this single document from time to time. We will post changes here and update the date above. Where required by law, we will provide additional notice.
20. Miscellaneous
- Entire agreement: This document constitutes the entire agreement between you and us regarding your use of the Site.
- Severability: If a provision is unenforceable, it will be modified to the minimum extent necessary or severed; the rest remains effective.
- No waiver: Our failure to enforce any provision is not a waiver of our rights.
- Assignment: You may not assign this document without our prior written consent. We may assign in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
- Notices: We may provide notices via the Site, email, or other reasonable means. You may send notices to info@horizon-track.com.
